Legal Division - Brief Description

Activity of Legal Division
  1. Advising the Central and State Governments, Central/State Electricity Regulatory Commissions, Generating Companies, Licensees on the techno-legal matters relating to generation, transmission, and distribution of electricity as per the provisions of the Electricity Act, 2003.
  2. Handling the work relating to framing of CEA regulations under the Electricity Act, 2003, such as previous publication of the regulations for inviting public comments, consultation with the Ministry of Power/Central Government in framing the regulations and legal vetting of other regulations by The Ministry of Law and Justice, and publication/notification of the final Regulations in the Gazette of India through the Department of Publication.
  3. Defending the Court Cases in Supreme Court/High Courts/District Courts/National Green Tribunal, in the matters related to the power sector where Union of India, Ministry of Power, and/or Central Electricity Authority are/is Respondents, by:
  4. Preparing replies of petitions for filing the Counter Affidavits,
  5. Briefing by the officers of the Legal Division to the Government Counsels/ASGs etc.,
  6. Attending the court hearings in important matters,
  7. Monitoring compliance with the directions/orders given by the Hon'ble Courts.
  8. Examination of Detailed Project Reports (DPR) of Hydro Electric Projects on legal aspects for concurrence of the Authority.
  9. Processing of bills for payment to the Government Counsels against the defending of the Court Cases pertaining to MoP and CEA.
  10. Publication of Advertisement/Notices for inviting public comments on the draft Regulations.
  11. Gazette Notification of the regulations in the Gazette of India.
